What Are The Legal Complications (if any) With My Idea?
2 close friends of mine have just found out that their son has Leukemia. He starts his chemotherapy tomorrow and his Mum is going to spend the whole time at the hospital with him. He could be there for a few weeks on the trot.

I'm sure most of you know that feeling of complete uselessness so I thought I would do something to cheer him up or, at least in some way, help them all out:

I'm into photography and have done some work on the side (only costs were covered with regard to processing) for friends & family. I was thinking about asking friends on Facebook to consider having a single/family/group/lifestyle portrait or a DVD slide show done for a very small fee (£15 or so). With that I would come to them and they would get a 10"x8" photo of their choice. The money - after processing (sod-all money in comparison) - would then go towards a fund for my friends. They could then use the money in a way that keeps their son happy (even if it's only for a few moments), whether it be for materials to keep him occupied while he's in hospital or at home while he recovers (I realise it's a long process). It's up to them.

I was just wondering if this could cause problems - legally - should someone on Facebook turn out to be a complete arse and bring this to the "wrong peoples'" attention? You hear/read stories about people that have been caught out by insurance companies, sued, and so-on. I don't want this to come across as some kind of charity, nor a way of myself making money as NONE of this money would go to me. It would merely be spent on processing & postage and the rest would be given to my friend's son.

I think it's a wonderful idea, but I also think that you will be dealing with such a small amount of money that it can all go under the radar. You won't be making so much money that you would have to report it as income before you spend it on the gifts.

If you want to make a clean accounting of it, I've seen some people set up a fund with a bank or simply open a new bank account for the express purpose of running this project. If it does turn into something where you have to declare the income (more than a couple hundred dollars), at least you will have a clean record to show the expense involved. If it costs you $ 3.00 for an 8x10 print that you will sell for $ 20, then at least you will be able to prove that it only generated $ 17 profit and so on.

If you were giving the money to the hospital, it would be different than if you were giving it as a gift to a friend. Your friend is not a registered charitable organization, so there is no write-off for simply doing something nice for the family.
